The review places each material element on a spectrum from publicly observable to effectively hidden and records commercial importance, evidence difficulty, and questions for counsel. Place each material element at publicly observable, inferable, access-dependent, or effectively hidden.
Evidence
List product behavior, outputs, interfaces, documentation, filings, public tests, and likely discovery needs.
Output
Record commercial importance, evidence difficulty, expected cost, and questions for counsel.
