Alpha to Patent

Alpha to Patent starts with the advantage a customer values, traces it to the technical or operating constraint that creates the value, tests whether the advantage survives better AI and easier engineering, and then chooses the narrowest useful mix of patents, trade secrets, know-how, data rights, contracts, regulatory position, licensing, publication, and operating control.

An advantage is not yet a right

Alpha to Patent studies how a useful commercial advantage becomes a defensible set of rights and operating controls. It begins with the result a customer values, identifies the constraint that makes the result hard to reproduce, and tests whether that constraint survives better AI, easier software, more capital, and a serious design-around attempt.

The answer may be a patent. It may also be know-how, data rights, contracts, a trade secret, publication, a mark, distribution, regulatory position, or disciplined execution. The program chooses among them rather than treating a filing as the goal.

The working sequence

Find the Native Alpha. Prove the customer value and the commercially irreducible constraint. Decide which rights and controls have a useful job. Compound the advantage through products, licenses, partnerships, evidence, and the next round of research.

Every conclusion remains open to contrary evidence. A granted right does not prove demand. Demand does not prove a durable advantage. Technical novelty does not guarantee either one.

Put this to work

Rights decision record

Decide whether an advantage calls for a patent, secrecy, contract, publication, a mark, operating discipline, or no special protection.

For
Founders, product owners, inventors, and counsel preparing an initial rights discussion.
What you keep
A rights decision record you can review, revise, and send.
What counts as sound
  • Separates customer value from product features
  • Names the evidence for scarcity
  • Tests design-arounds
  • Explains what each proposed right would do
  • Ends with a dated decision
